These terms explain the responsibilities that come with using Mermaids, connecting third-party services, and working with AI-assisted features.

Acceptance and eligibility
These Terms and Conditions ("Terms") govern your access to and use of Mermaids websites, applications, and AI-powered customer relationship management services (collectively, the "Services"). By using the Services, you agree to these Terms and our Privacy Policy.
You must be legally able to enter into a binding contract. If you use the Services for an organization, you represent that you have authority to bind that organization, and "you" includes the organization.
Accounts and administrators
You must provide accurate account information, protect your credentials, and promptly notify us of suspected unauthorized access. You are responsible for activity under your account.
If your account is managed by an organization, its administrators may control access, configure integrations, access or export Customer Content, and manage or terminate accounts consistent with the organization's agreement and applicable law.
The Services
Mermaids helps users organize customer records, communications, calendars, tasks, opportunities, and related workflows. We may add, modify, suspend, or discontinue features as the product evolves. We will provide reasonable notice when a material change significantly reduces core paid functionality, where practical.
Beta, preview, and early-access features may be incomplete, change without notice, and be subject to additional terms.
Google and third-party integrations
You may choose to connect third-party services such as Gmail and Google Calendar. You authorize Mermaids to access and process data from those services only within the permissions you approve and as described in our Privacy Policy.
You are responsible for complying with third-party terms. Third-party services are operated independently, and their availability or changes may affect integrations. You can disconnect an integration through the Services or the third party's permission controls.
Customer Content and permissions
You retain ownership of information, files, communications, and other content submitted to or connected with the Services ("Customer Content"). You grant Mermaids a limited right to host, process, transmit, and display Customer Content only as needed to provide, secure, support, and improve the Services.
You represent that you have the rights and permissions required to provide Customer Content and to allow its processing under these Terms. You are responsible for configuring user access and ensuring your use complies with privacy, employment, communications, and other applicable laws.
AI-assisted features
The Services may generate summaries, classifications, suggestions, forecasts, or other outputs using artificial intelligence. Outputs may be inaccurate, incomplete, or unsuitable for your circumstances and should not replace professional judgment.
You are responsible for reviewing outputs before relying on them, sending communications, changing records, or making business, legal, employment, financial, or other decisions. You must not represent AI-generated content as verified when it has not been reviewed.
Acceptable use
You may not use the Services to violate law or third-party rights; send spam or deceptive communications; distribute malware; obtain unauthorized access; interfere with service integrity; reverse engineer protected portions of the Services; scrape or resell the Services; develop competing models using outputs at scale; or process highly sensitive data unless expressly supported and agreed in writing.
We may investigate suspected violations and suspend access when reasonably necessary to protect users, third parties, or the Services.
Mermaids ownership and feedback
Mermaids and its licensors own the Services, software, designs, documentation, trademarks, and related intellectual property, excluding Customer Content. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your authorized subscription or access period.
If you provide feedback, you allow us to use it without restriction or compensation, provided we do not identify you publicly without permission.
Fees, suspension, and termination
Paid plans, billing cycles, usage limits, taxes, renewal, and cancellation terms will be shown when you subscribe or in an applicable order form. Except where required by law or stated otherwise, fees are non-refundable.
You may stop using the Services at any time. We may suspend or terminate access for material breach, security risk, non-payment, legal requirement, or harm to the Services or others. Upon termination, your right to use the Services ends. Provisions that by nature should survive will remain effective.
Disclaimers and liability
To the maximum extent permitted by law, the Services are provided "as is" and "as available." Mermaids disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Services will be uninterrupted, error-free, or produce a particular business result.
To the maximum extent permitted by law, Mermaids will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenues, data, goodwill, or opportunities. Mermaids' aggregate liability arising from the Services will not exceed the amount you paid for the Services during the 12 months before the event giving rise to the claim.
General terms and contact
You will indemnify Mermaids against third-party claims arising from Customer Content, your unlawful use of the Services, or your material breach of these Terms, to the extent permitted by law. These Terms, together with any applicable order form and policies referenced here, form the entire agreement about the Services.
If any provision is unenforceable, the remaining provisions remain effective. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets. A failure to enforce a provision is not a waiver.
We may update these Terms and will post the revised version with a new effective date. Questions can be sent to legal@mermaids.ai.
